Terms of Service

These Terms of Service govern your access to and use of FindNepali.com (“FindNepali,” “we,” “us,” or “our”), including our business directory, marketplace, business listings, user accounts, paid and premium features, informational tools, and related services.

By accessing FindNepali, creating an account, posting or claiming a listing, purchasing a paid feature, or otherwise using the Platform, you agree to these Terms.

If you do not agree, please do not use FindNepali.

About FindNepali

FindNepali is a community-focused platform that helps users discover and connect with businesses, professionals, products, services, jobs, housing opportunities, and other resources, particularly within Nepali communities.

FindNepali also provides marketplace and informational features, including business profiles, advertisements, appointments or inquiries, daily information tools, and astrology-related tools.

Unless we expressly state otherwise, FindNepali is a platform and is not the seller, employer, landlord, real-estate broker, attorney, financial adviser, healthcare provider, or service provider involved in listings posted by independent users or businesses.

Eligibility and Accounts

You must be at least 18 years old, or the legal age required to enter into a binding agreement in your jurisdiction, to independently:

• create a commercial account.
• post marketplace listings.
• claim or manage a business.
• purchase paid services; or
• enter transactions through FindNepali.

When creating an account, you agree to provide accurate and current information and keep your login credentials secure.

You are responsible for activity occurring through your account.

We may restrict or suspend accounts involving false information, fraud, unauthorized business claims, misuse, or violations of these Terms.

Business Listings and Claims

FindNepali allows businesses and professionals to create, claim, verify, and manage business profiles.

FindNepali may also create unverified business profiles using legitimate publicly available information, including information from:

• official business websites.
• public social-media pages.
• public records.
• professional directories; and
• other publicly accessible business sources.

An unverified listing does not mean the business has created, approved, or entered into a commercial relationship with FindNepali.

Only a business owner, authorized manager, or authorized representative may claim a business profile.

We may request information reasonably necessary to verify a claim.

Businesses may request corrections to inaccurate information.

Verified, Featured and Paid Listings

FindNepali may offer Free, Standard, Premium, Featured, Verified, Sponsored, or other listing options.

A “Verified” status generally means FindNepali has completed certain verification steps. It does not guarantee:

• licensing.
• professional qualifications.
• financial condition.
• service quality.
• reliability.
• safety; or
• future performance.

Likewise, Premium, Featured, or Sponsored placement may involve paid promotion and should not be interpreted as an independent ranking or endorsement.

No paid listing guarantees customers, inquiries, sales, revenue, website traffic, or search-engine rankings.

Marketplace Listings

FindNepali provides a community marketplace where users and businesses may advertise products, vehicles, jobs, rooms, real estate, services, and other permitted items or opportunities.

Unless FindNepali expressly identifies itself as the seller, transactions are between the buyer and seller or between the parties identified in the listing.

Users are responsible for:

• verifying the identity of the other party.
• inspecting products or services.
• confirming prices and conditions.
• checking licenses and ownership.
• reviewing contracts.
• arranging delivery or performance.
• paying applicable taxes; and
• complying with applicable laws.

FindNepali does not guarantee that an item exists, that a seller has legal ownership, that a buyer will complete payment, or that a transaction will be successful.

Use reasonable caution when dealing with people you do not know.

Seller, Business and Listing Responsibilities

Anyone posting a listing represents that:

• the information is truthful and not materially misleading.
• they have the right and authority to post it.
• photographs and content may legally be used.
• products or services offered are lawful.
• prices and important conditions are accurately represented; and
• applicable licenses, permits, registrations, taxes, and legal requirements will be maintained.

Job, housing, real-estate, and service listings must comply with applicable federal, state, and local anti-discrimination laws.

FindNepali may reject, edit, restrict, or remove listings that violate these requirements.

Prohibited Listings and Activities

You may not use FindNepali to advertise, sell, promote, request, or facilitate:

• illegal goods or services.
• stolen or counterfeit goods.
• unlawful weapons or explosives.
• illegal drugs or controlled substances.
• fraudulent financial schemes.
• pyramid or deceptive investment schemes.
• trafficking or exploitation of persons.
• unlawful sexual services or obscene illegal material.
• goods or services that infringe intellectual-property rights.
• discriminatory housing or employment opportunities.
• fraudulent immigration or professional services; or
• anything prohibited by applicable law.

You also may not:

• impersonate another person or business.
• post fake or misleading listings.
• manipulate reviews or ratings.
• distribute malware or harmful software.
• attempt unauthorized access to accounts or systems.
• scrape or systematically copy substantial portions of the FindNepali database without authorization.
• collect personal information for unlawful purposes; or
• use FindNepali for scams, spam, harassment, threats, or fraud.

Reviews and User Content

Users may submit reviews, photographs, descriptions, advertisements, comments, messages, and other content.

You retain ownership of content that you legally own.

By submitting content to FindNepali, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, format, reproduce, distribute, and process that content as reasonably necessary to operate, secure, improve, and promote FindNepali and the applicable listing.

You do not transfer ownership of your content to FindNepali.

Honest positive or negative opinions are permitted. FindNepali does not penalize users simply for providing a genuine negative review.

However, we may remove or restrict content that is:

• fake or fraudulent.
• knowingly false or misleading.
• defamatory.
• threatening or harassing.
• discriminatory.
• unrelated to the listing.
• privacy-invasive.
• unlawfully incentivized or manipulated.
• infringing; or
• otherwise unlawful.

Businesses may not purchase, create, or encourage fake reviews or offer rewards that require a particular positive or negative opinion.

Professional and Regulated Services

FindNepali may list attorneys, immigration professionals, Realtors, mortgage professionals, insurance professionals, accountants, contractors, healthcare-related businesses, financial professionals, and other regulated service providers.

FindNepali does not guarantee any professional's license, qualification, competence, or suitability.

Users should independently verify credentials with the appropriate licensing or regulatory authority.

Using FindNepali does not create an attorney-client, doctor-patient, financial-adviser, broker-client, or other professional relationship with FindNepali.

Informational and Astrology Features

FindNepali may display information such as:

• gold and silver prices.
• currency exchange rates.
• bank interest rates.
• articles and market information.
• daily horoscope.

Kundli or horoscope generation;

Panchang;

matchmaking or compatibility;

Muhurat; and

numerology.

Financial, currency, gold-price, banking, or similar information is provided for general informational purposes only and may be delayed, incomplete, or obtained from third-party sources.

It is not investment, financial, tax, or professional advice. Users should verify important information with official sources before making financial decisions.

Astrology, Kundli, horoscope, matchmaking, numerology, and similar features are provided for cultural, informational, spiritual, or entertainment purposes. Results are not guarantees or scientific predictions and should not replace medical, legal, financial, psychological, or other professional advice.

Payments, Premium Services and Subscriptions

Certain FindNepali services may require payment, including Premium or Featured listings, advertising, subscriptions, digital products, or other paid features.

Before payment, FindNepali will display the applicable price and material terms of the purchase.

Payments may be processed by third-party payment processors, banks, card networks, or digital-wallet providers.

By completing a purchase, you authorize FindNepali and its payment partners to process the applicable charge, taxes, refunds, adjustments, or other authorized amounts.

If a service automatically renews, the renewal price, billing frequency, and cancellation method will be disclosed before enrollment as required by applicable law.

You are responsible for maintaining accurate payment information.

Cancellations, Refunds and Chargebacks

Cancellation and refund rights may depend on the product, listing plan, promotional offer, subscription, and applicable law.

Any specific refund or cancellation terms displayed during checkout or purchase will form part of these Terms.

Unless otherwise stated, cancelling a recurring plan prevents future renewals but does not automatically refund an already completed billing period, except where required by law or approved by FindNepali.

Duplicate charges, incorrect charges, technical billing errors, or other legitimate payment concerns may be reviewed by FindNepali.

Users retain their legal rights to dispute unauthorized or improper charges through their financial institution. Fraudulent or abusive use of refunds or chargebacks may result in account restrictions.

Communications and SMS

FindNepali may send communications concerning:

• account verification.
• listing activity.
• business claims.
• inquiries or appointments.
• payments.
• security alerts.
• service updates; and
• other transactional matters.

Marketing SMS or similar communications will be sent only where permitted by applicable law and where any required consent has been obtained.

Where applicable, users may reply STOP to opt out of marketing text messages.

Consent to marketing text messages is not required as a condition of purchasing a FindNepali service unless otherwise permitted by law.

Third-Party Services and Links

FindNepali may contain links or integrations involving:

WhatsApp;

business websites;

social-media platforms;

maps;

payment processors;

analytics providers;

APIs;

financial-data providers; and

other third-party services.

FindNepali does not control and is not responsible for the content, security, availability, products, services, or privacy practices of independent third parties.

Their own terms and privacy policies may apply when you use their services.

Intellectual Property and Copyright

The FindNepali name, logos, website design, software, original graphics, database structure, and FindNepali-created content are protected by intellectual-property laws.

These Terms do not give users ownership of FindNepali intellectual property.

Business names, trademarks, photographs, advertisements, and other third-party content remain the property of their respective owners.

If you believe content on FindNepali infringes your copyright or other intellectual-property rights, please submit a complaint through our official contact channel identifying:

• the protected work.
• the allegedly infringing material and its location.
• your contact information; and
• your authority to act for the rights holder.

FindNepali may remove infringing material and restrict repeat infringers as appropriate.

Privacy

Your use of FindNepali is also governed by our Privacy Policy and Cookie Policy.

Those policies explain how FindNepali collects, uses, shares, stores, and protects personal information, including account, listing, payment-related, communications, and usage information.

Service Availability

FindNepali may add, modify, suspend, or discontinue features at any time.

We do not guarantee that:

• the Platform will always be available or error-free.
• every listing will be accurate or current.
• every business or user is legitimate.
• every inquiry will receive a response.
• a marketplace transaction will be completed.
• a payment method will always be available; or
• any listing will receive a specific level of traffic or business.

Disclaimer of Warranties

To the maximum extent permitted by law, FindNepali and its services are provided “AS IS” and “AS AVAILABLE.”

FindNepali disclaims warranties not expressly provided by us, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent those warranties may lawfully be disclaimed.

Nothing in these Terms limits warranties, consumer protections, or legal rights that cannot lawfully be waived.

Limitation of Liability

To the maximum extent permitted by applicable law, FindNepali and its owners, officers, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, revenue, data, goodwill, or business opportunities arising from use of the Platform.

Where FindNepali is legally liable, our total aggregate liability for a claim will not exceed the greater of:

• the amount you paid directly to FindNepali during the 12 months preceding the event giving rise to the claim; or

US $100 if you did not pay FindNepali during that period.

This limitation does not apply to fraud, intentional misconduct, or other liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to defend and indemnify FindNepali against third-party claims, damages, liabilities, and reasonable legal expenses resulting from:

• content or listings you submit.
• products or services you offer.
• your violation of these Terms.
• your violation of applicable law.
• your infringement of another person's rights; or
• fraudulent or unauthorized activity conducted through your account.

This provision applies only to the extent the claim was caused by your conduct and does not eliminate rights that cannot legally be waived.

Suspension and Termination

FindNepali may restrict, suspend, remove, or terminate an account or listing where reasonably necessary because of:

• violations of these Terms.
• fraud or suspected fraud.
• illegal activity.
• unauthorized business claims.
• repeated intellectual-property violations.
• abusive or threatening conduct.
• payment or chargeback abuse.
• security concerns.
• regulatory requirements; or
• risks to users or the Platform.

Users may stop using FindNepali at any time.

Termination does not cancel outstanding payment obligations, disputes, refunds, chargebacks, taxes, or other obligations that reasonably survive termination.

Changes to These Terms

We may update these Terms as FindNepali develops, introduces new services, or responds to legal or regulatory requirements.

The Last Updated date will identify the latest version.

If a change materially affects users or paid services, we may provide additional notice where appropriate or required by law.

Continued use after updated Terms become effective constitutes acceptance of the revised Terms where permitted by law.

Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law, without regard to conflict-of-law principles.

Unless applicable consumer law requires otherwise, disputes involving FindNepali will be brought in a state or federal court of competent jurisdiction located in Pennsylvania.

Nothing in these Terms prevents a consumer from exercising rights or remedies provided by laws that cannot legally be waived.

Severability and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy, Cookie Policy, applicable payment or subscription terms, and any additional policies expressly incorporated into them, constitute the agreement governing your use of FindNepali.
